Placing an order constitutes an offer to purchase. cushnstep may accept or reject any order at its discretion. Your order is not accepted until we send confirmation. Payment must be received and processed before acceptance.

Please review your order carefully before submitting; we may be unable to cancel it after acceptance. If we reject or modify an order, we will try to notify you using the contact details provided.

All purchases are subject to our Refund Policy [LINK]. You warrant that you are buying for personal or household use, not for resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price in effect at the time of your order will appear in your order confirmation email. Unless stated otherwise, prices do not include taxes, shipping, handling, customs, or import fees.

Online prices may differ from those in physical stores or on third‑party sites. Promotions may have separate terms; if there is a conflict, the promotion terms control.

You agree to provide accurate and up‑to‑date purchase and payment information. You will promptly update your account (e.g., email, credit card details) so we can complete your transactions and contact you as needed.

You represent and warrant that (i) your credit card information is true and correct, (ii) you are authorized to use that card, (iii) your card company will honor the charges, and (iv) you will pay all charges, including shipping and taxes.

We are not liable for shipping or delivery delays. All delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events beyond our control. Once we transfer products to the carrier, title and risk of loss pass to you.

Our Services – including all trademarks, text, images, graphics, product reviews, video, audio, and their arrangement – are owned by cushnstep, its affiliates, or licensors, and are protected by U.S. and international intellectual property laws.

cushnstep’s names, logos, product names, designs, and slogans are our trademarks. Shopify’s trademarks belong to Shopify. Other trademarks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third‑party tools as part of the Services. We do not monitor or control those tools.

You acknowledge that we provide such tools “as is” and “as available” without any warranties or endorsements. We have no liability arising from your use of optional third‑party tools. You use them at your own risk and should review the terms of the relevant third‑party providers.

We may offer new features or tools in the future; they will also be subject to these Terms.

SECTION 8 – THIRD‑PARTY LINKS

Our Services may contain links to third‑party websites or content. We are not responsible for examining or evaluating that content. If you leave our Services to visit a third‑party site, you do so at your own risk.

cushnstep is powered by Shopify, but all sales are directly between you and cushnstep. By using our Services, you agree that Shopify is not responsible for any aspect of your purchases or transactions with us, including any injury, damage, or loss. You release Shopify and its affiliates from all claims arising from your purchases with cushnstep.

SECTION 10 – PRIVACY POLICY

Personal information we collect is subject to our Privacy Policy [LINK] and, in some cases, Shopify’s Privacy Policy (linked). By using our Services, you acknowledge you have read both policies.

14.4 Agents must: (i) include “Agent/[agent name]” in the user agent string of every HTTP/HTTPS request; (ii) not conceal that they are automated (e.g., mimicking humans or solving CAPTCHAs); (iii) answer truthfully when asked if they are human or automated; (iv) not circumvent any measures we use to control Agent access.

We may terminate this agreement or your access to the Services at any time, without notice. You will remain liable for all amounts due up to the termination date.

Sections that by their nature should survive termination will continue to apply.

TO THE FULLEST EXTENT PERMITTED BY LAW, CUSHNSTEP, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS (AND THOSE OF SHOPIFY) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless cushnstep, Shopify, and our affiliates, officers, directors, employees, agents, and service providers from any losses, damages, claims, or expenses (including reasonable attorneys’ fees) arising from (1) your breach of these Terms, (2) your violation of any law or third‑party rights, or (3) your use of the Services.

We will notify you of any such claim. We may control the defense and settlement at your expense, but will not settle any claim requiring non‑monetary obligations from you without your consent. You will cooperate with us.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions remain in full effect.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision does not waive that right.
